NEW RECEIVERSHIP - Anna J. Warnock DDS Inc et al - 03-28-14

On March 28, 2014 Delaware County Common Pleas Court Civil Division Judge Everett H. Krueger  appointed Peter M. Lahni, Jr. as receiver for Anna J. Warnock, et al in Columbus, OH.  Anna J. Warnock is a dentist who had two leased spaces where she ran dental practicies.  She closed one location at the end of January and one location at the end of February.  The landlords had thoughts of having the receiver cover all of the unpaid rent of the debtor.  The receiver was working with the landlords to find dentists to take over the locations with equipment staying in place.  The receiver was negotiating with a couple of dentists without success.  The landlord of the best location made an offer to purchase the equipment from his location.  In discussion and negotiation, the receiver had the landlord purchase the equipment in both locations for $80,000.

The next challenge was selling the patient list.  The receiver was negotiating with one dentist that was changing their offer every 15 minutes.  The debtor had control of all of the patient records and was working for another dentist.  The employer dentist made an offer to the receiver of $20,000.  After the transaction was agreed to and paid, the first dentist came back and said that she would pay more after the transaction was approved by the court and funds received.  Too late.

The last challenge was getting Chase Bank to turn over the balance of the business checking account to the receiver.  After several weeks, the receiver was successful. 

The funds were turned over to PNC Bank on June 26, 2014.  PNC Bank is paying the receiver and its counsel outside of the closing during the first week of July 2014.
